This website ("www.myammolite.com", the “Website”), operated by My Ammolite (International) Ltd (“My Ammolite”, "we", “our”, “us”), is available to you on the condition that you accept without modification the terms, conditions and notices contained herein. Please read these terms and conditions carefully before using the Website. By using the Website or any part of it, including purchasing products and services, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.

1. These Terms

1.1 These are the terms and conditions (“Terms”) on which we supply products to you, whether these are products, services or digital content.

1.2 Please read these Terms carefully before you use our Website and/or submit your order requests to us. These Terms (together with the documents referred to on it, including our Privacy Policy) tell you who we are, how we will provide products, services or digital content to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

2. Registration

2.1 You are required to register with us when you use the services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.

2.2 All purchases made by you through our site will be within the scope of your authority to conclude contracts.

2.3 In consideration of your use of our services, you agree to:

2.3.1 provide true, accurate, current and complete information about yourself when filling out our registration form; and

2.3.2 maintain and promptly update your registration information to keep it true, accurate, current and complete. If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration.

3. Orders

3.1 Once you placed an order request through our Website, you agree to purchase those Products from the providers at the price listed on the date of purchase on the relevant Product description page.  You cannot cancel an order once it has been submitted, even if our acceptance or rejection of your order is still pending. We will send you an order confirmation email upon the confirmation of your order.

3.2 We reserve our right not to accept or cancel an order for any reasons at our sole discretion, including without limitation:

  • no sufficient stock to deliver the product you have ordered.

  • no delivery can be arranged for your area.

  • one or more of the product you ordered was listed at an incorrect price due to a human or computer error or an error in the pricing information provided by the us.

  • we are unable to meet a delivery date request you have specified.

3.3 If we cancel your order we will notify you by email/ app push notification and will credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 10 working days of your order. You accept that we will not be obliged to offer any compensation for disappointment suffered.

4. Products

4.1 All pictures and images and details of the Products displayed on the Website are for illustration purposes only, in order to help you recognize the Products. The actual size, dimension and colour of the Products may differ.

4.2 Our right to make minor changes to products. We may make changes to products available on our Website. These changes may affect your use of our products.

4.3 We reserve the right to change the Products offered online at any time by announcement via the Website, email or any other means of public communication.

5. Price and payment

5.1  The price of the product will be the price indicated on the order pages when you placed your order request. All prices are listed and charged in Hong Kong Dollars (HKD).

5.2 The online payment platforms that can be used for products ordered in My Ammolite online store are as follows:

  • Stripe (Credit card)

  • PayMe

  • FPS

  • Local Bank Transfer

5.3 We reserve the right to change the payment terms for any order without prior notice.

5.4 The credit card used for shopping should be valid and under your own name. We reserve the right to terminate any transaction it considers suspicious. We shall not be liable for any payment fraud. All payment methods require you to pay before delivery of the Products to you. Full payment in respect of an order must be made upon the placing of that order. If your payment cannot be processed, the order will not be accepted.

5.5 In the event that you think the transaction price provided by us is wrong, please contact us at info@lkytea.com.

6. Delivery

6.1 Local Customers: Free Delivery threshold to HKD800 or above per order (after discount). Otherwise, delivery fee (by SF-express) is at HKD30.

  • Overseas Customers: Airmail by Hong Kong Post and Speedpost (EMS) are available. Delivery rates will be charged according to the parcel weight and it will be displayed at your shopping cart.

  • We reserve the right to adjust the amount of order for free delivery

6.2 Delivery service will be suspended if the Red/ Black Rainstorm Warning Signal or Tropical Cyclone Signal No. 8 (or above) is hoisted, or under any weather condition deemed unsuitable for delivery.

6.3 Normally products will be sent out within 3 working days.

6.4 We will deliver the product ordered by you to the address you give us for delivery at the time you make your order through our staff or a third-party provider. The product shall be, and shall be deemed to be, delivered and accepted by you when the product(s) are delivered to the address you give us for delivery. You agree and accept that we are entitled, at our option, to charge you additional costs or cancel your order without any refund or compensation to you in the event of your failure to accept delivery for whatever reasons.

6.5 You will become the owner of the product you have ordered when they have been delivered to you. Once product has been delivered to you, they will be held at your own risk and we will not be liable for the loss or damage.

6.6 You are requested to examine the goods immediately upon delivery for any deficiencies and/or damages. Claims (if any) must be lodged to us by email. We shall have the discretion to refuse your claim after delivery.

6.7 All discount items, free gifts and redemption items are subject to stock availability. No substitution and no prior notice will be made if stock is not available.

6.8 No return or exchange of product will be accepted.

7. Promotion Codes, Coupon Codes and Coupons

7.1 Promotion codes, coupon codes and coupons offered by us shall only be applicable for one-off purchase at our site subject to special terms and conditions.

7.2 Promotion codes, coupon codes and coupons are neither refundable nor redeemable for cash. Any unused amount will be forfeited.

7.3 If your order is cancelled for whatever reason or is eligible for a refund, any promotion codes, coupon codes or coupons used in that order shall be forfeited without any refund or compensation.

7.4 We reserve the right to terminate or vary the above offers from time to time without providing any prior notification. In the event of any dispute, our decision shall be final and conclusive.

8. Liability

8.1 Any losses incurred or sustained by you in transmitting payment information shall be borne solely and exclusively by you and in no event shall any such losses be, in whole or in part, borne by us. If you are using a public computer, you shall ensure that you sign out of the Website once you have finished browsing the Website.

8.2 We shall not be liable in any way for any damages, losses, costs, expenses, liabilities or compensation, whether direct or indirect, which arise from or are in connection with your access and use of the Website; or any breach of security, delay, corruption or destruction of data or systems (including but not limited to those caused by any virus or other malicious code), transmission error, inaccessibility (whether in connection with upgrading or modification of the Website, failure or insufficiency of the technical facilities or technical issues on the user’s side) of the Website; or any part thereof, whether due to the negligence of us or its officers, employees, agents, contractors or otherwise.

9. Intellectual Property Rights

9.1 Any use of materials on the Website, including alteration, modification, distribution or republication, without our prior written consent is prohibited.

10. Data Protection

10.1 When purchasing Products on the Website, you agree that we can store, process and use the data you provide for handling your order.

10.2 We are committed to safeguarding the privacy of all individuals with respect to their personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong. Please refer to our Privacy Policy.

11. General

11.1 In case of any dispute between the Parties in respect of or in connection with these terms and conditions, My Ammolite's determination shall be final and binding.

11.2 These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region ("Hong Kong") and both you and we agree to submit to the exclusive jurisdiction of the Hong Kong courts.

11.3 We may revise these terms and conditions at any time without prior notice. If any dispute arises, My Ammolite’s determination shall be final.

11.4 Where these terms and conditions are available in Traditional and/or Simplified Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy among the versions.
